Hurricane Marsh Wholesale Territory Protection Policy

Our territory protection guidelines exist to protect and support retail partners who are committed to Hurricane Marsh, actively invested in carrying our brand, and focused on building a long-term relationship with us.

Territory Protection Requirements

To qualify for territory protection, a retailer must meet the following requirements:

Brick & Mortar Storefront
Retailer must operate a traditional brick & mortar storefront with a dedicated retail sales floor. Priority will be given to storefronts larger than 1,000 square feet with a strong focus on men’s apparel, outdoor lifestyle, hunting, fishing, or sporting goods.
Territory Protection / Trade Area
Territory protection may be considered for qualifying brick & mortar retailers upon request. Because every market is different, approved territory protection is determined on a case-by-case basis and is based on factors such as town size, population, retail density, customer base, store type, order volume, product assortment, and continued support of the Hurricane Marsh brand. Territory protection is not based on a guaranteed mileage radius and may be modified at any time at the discretion of Hurricane Marsh.
Ongoing Order Requirement
To maintain territory protection, the retailer must order a minimum of $5,000 per year.
Brand Commitment
Territory protection is dependent on the amount of Hurricane Marsh product carried in-store, the variety of styles offered, reorder activity, and the retailer’s overall commitment to representing the brand well.
Annual Review
Territory protection is subject to review at any time and may be revoked if the retailer does not meet the ongoing requirements, cancels purchase orders, fails to reorder, or does not maintain an active Hurricane Marsh presence in-store.

Stores That Do Not Qualify for Territory Protection

Retailers operating in spaces smaller than 1,000 square feet, booth-style locations, seasonal shops, online-only stores, pop-ups, or stores that do not have a strong focus on apparel may still be approved to carry Hurricane Marsh products. However, these accounts may not be eligible for territory protection.

These retailers may also lose the ability to carry Hurricane Marsh apparel if a qualifying brick & mortar retailer is approved within the protected trade area.

Trade Area Exceptions

Hurricane Marsh reserves the right to approve additional retail partners within or near an existing territory when:

The existing retailer does not meet territory protection requirements
The market size can support more than one retail partner
The store serves a different customer base or class of trade
The existing retailer has limited product assortment or low reorder activity
The new retailer offers a stronger long-term opportunity for brand growth

Big box retailers, national accounts, online sales, event sales, and special partnerships may be considered separate classes of trade and are not automatically subject to local territory protection policies.

Final Approval

All territory protection is granted at the sole discretion of Hurricane Marsh and may be modified or revoked at any time based on retailer performance, market conditions, order history, and brand alignment. At Hurricane Marsh, we value strong, long-term relationships with retail partners who are committed to growing with our brand. Because of that, territory protection may be offered upon request, but it is not automatically guaranteed. Our goal is to protect and support retail partners who are actively investing in Hurricane Marsh, while also allowing the brand room to grow in each market.

Retail Partner Agreement Terms.

Freight

All freight will be on buyer. All freight is on buyer with insurance premium included to shipping cost. If you do not provide a shipping account, shipping costs will be billed to your payment method on file.

Payment Terms & Account Standing

Hurricane Marsh offers Net 30 payment terms to approved wholesale accounts in good standing. Payment by ACH is preferred.

If a retailer chooses to pay by credit card, the applicable transaction fee will be added to the invoice. Credit card payments are due before shipment, and Net 30 terms will not apply to orders paid by card.

If a retailer chooses to pay by check, a valid credit card must also be kept on file. If payment by check is not received by the invoice due date, Hurricane Marsh reserves the right to charge the card on file for the outstanding balance, including any applicable transaction fees.

Retailers with past-due balances may have Net 30 terms suspended or revoked. No new orders will be shipped until all past-due balances are paid in full and funds have cleared.

Hurricane Marsh reserves the right to require prepayment, ACH payment, or credit card payment before shipment for any account with late payments, returned payments, or inconsistent payment history.

Opening Order

The minimum buy-in order value is set at $2,000.

Order Placement

Order should be placed using the wholesale order portal.

Pricing

MSRP is listed on all wholesale order forms. Wholesale pricing is listed on the wholesale order form. We will try and keep pricing as close to 50% MSRP as possible. Pricing is subject to change without notice.

Returns

All returns must be approved. Returns for manufacturers' defects or wrong items shipped should be made within seven days of receiving the order. Please notify us as soon as possible by email.

Lead Time

While most orders we will process as soon as we can, please allow 30 days from the time of your order for completion. Larger orders may require more time. Please contact for availability. Trade shows and events affect processing times.

Tax & Resale Documentation

Retailers must submit a valid resale certificate, business license, and/or Federal Tax ID number as part of the wholesale account approval process. Hurricane Marsh may request updated documentation at any time to verify account eligibility and maintain accurate records.

Wholesale Account Permissions

Hurricane Marsh reserves the right to approve, deny, suspend, or revoke wholesale account privileges at any time, at its sole discretion, based on account standing, payment history, order activity, brand alignment, or violation of wholesale terms.

Third-Party Marketplace Sales

Retailers may not sell Hurricane Marsh products through third-party marketplaces or resale platforms, including but not limited to Amazon, Walmart, Target, eBay, Etsy, or similar online marketplaces, without prior written approval from Hurricane Marsh.

Hurricane Marsh products may only be sold through the retailer’s approved brick & mortar location, approved business website, or other sales channels specifically authorized by Hurricane Marsh.

Wholesale Ordering Requirements

Wholesale accounts are intended for retail resale only and may not be used for personal shopping, gift purchasing, or one-off individual orders. Hurricane Marsh requires minimum quantities per style on all wholesale orders to ensure each order reflects a true retail assortment.

Changes to Wholesale Terms

Hurricane Marsh reserves the right to update, modify, or discontinue these wholesale terms, policies, requirements, and account privileges at any time, at its sole discretion. Continued participation in the Hurricane Marsh wholesale program constitutes acceptance of the most current terms and policies.
